Business and Planning Act 2020 (Pavement Licences) (Coronavirus) (Amendment) Regulations 2022

The Business and Planning Act 2020 brought a temporary streamlined pavement licence sytem into effect as a response to the pandemic, with the system (and licences granted under it) due to cease on 30 September 2022.

The Government’s recent Levelling-up and Regeneration Bill intends to make that system permanent but it is clear that the Bill is unlikely to become law before the current system expires.

Accordingly, the Government is looking to bring the Business and Planning Act 2020 (Pavement Licences) (Coronavirus) (Amendment) Regulations 2022 into force. This will amend the Business and Planning Act 2020 so that its temporary pavement licence sytem will now be extended by 12 months to 30 September 2023.

The extended date will not automatically extend licences so anyone that has a pavement licence expiring 30 September 2022 will still need to apply for it to be renewed once the Business and Planning Act 2020 (Pavement Licences) (Coronavirus) (Amendment) Regulations 2022 comes into force.
